Estate Planning in Romania at a Glance

Romania follows civil law with strict forced heirship (moștenitori rezervatari) protecting descendants, ascendants, and surviving spouse. Reserved portion is 1/2 for one child, 2/3 for two, 3/4 for three or more children. No inheritance tax but notary fees and stamp duties apply. Authentic (notarial) wills are most secure.

Family Shares and Estate Administration in Romania

Protected family shares: Moștenitori rezervatari (reserved heirs): One child 1/2, two children 2/3, three+ children 3/4. Surviving spouse gets minimum 1/4. Parents get 1/4 if no descendants. Cannot disinherit except for serious legal grounds.
Administering the estate: Two stages: Notarial certificate of inheritance, then court validation if contested. Holographic wills must be validated by court. Process typically takes 3-6 months. All heirs must be notified.
